John Brownlee - REPEAL THE "TRIGGERMAN RULE" - Will Ken Cuccinelli Stand With Tim Kaine Again?

I bet he does.

Republicans in the Virginia House and Senate, as well as a few right-minded Democrats, voted in 2007 to abolish the Triggerman Rule.  The bill passed overwhelmingly, but was vetoed by Governor Kaine.  Every Republican - and several Democrats - in the House of Delegates voted to override the Governor's veto, and they were successful.  Unfortunately, the Senate voted to sustain the Governor's veto and the bill died.
Pro-law enforcement legislators tried again in 2008 to repeal the Triggerman Rule and again the bill passed both the House and Senate by wide margins.  Once again, Governor Kaine - who is opposed to the death penalty -- vetoed the legislation.  Once again, the House overrode the veto.  And, once again, the Democrats in the Senate, with the assistance of only one Republican -- Ken Cuccinelli - sustained the Governor's veto.

How important is repeal of the Triggerman Rule to the pursuit of criminal justice in Virginia?  Take a look at those who agree with John Brownlee that this rule needs to be eliminated:
Bob McDonnell and Bill Bolling - long-time, solid supporters of law enforcement and victims' rights in Virginia - support repeal of the Triggerman Rule.

Even more interestingly, all three Democrat candidates for Governor support repeal of the Triggerman Rule.  Tim Kaine is so far outside the mainstream on this law enforcement issue that all of his own Party's candidates to replace him disagree with him on this issue.

The Virginia Sheriffs' Association supports its repeal.

The Virginia Association of Commonwealth's Attorneys supports its repeal.

The Virginia Crime Commission supports its repeal.

The likely Democrat nominee for Attorney General, Steve Shannon, supports repeal of the Triggerman Rule, as does one of John's Republican competitors, Dave Foster.

Earlier today, the Virginia Association of Chiefs of Police issued a press release calling for the legislature to override Governor Kaine's veto (the text of that release appears below). 
Repeal of the Triggerman Rule is an important step in making Virginia's citizens safer from violent crime, and will assist law enforcement in its efforts to rid our streets of the most violent, despicable criminals in our midst.
PLEASE contact your legislators right away, prior to the "Veto Session" of the General Assembly on April 8, and ask them to vote to override Governor Kaine's veto of the Triggerman Rule legislation.  Information on contacting your legislators can be found here.
Together, we can remove this anti-justice rule from Virginia law and give law enforcement another weapon against violent crime.

As an organization comprised of law enforcement leaders, our members have seen firsthand the negative impact that Virginia's Triggerman Rule has had on the pursuit of justice in our Commonwealth's most heinous crimes.

The Triggerman Rule is clearly a loophole in Virginia's death penalty laws, benefiting the most brutal criminals in society while standing in the way of justice for many victims of violent crime. We strongly support the repeal of this rule.

As a matter of public safety, we encourage the Virginia General Assembly to overturn Governor Kaine's veto of the repeal of this anti-justice rule during the reconvened session on April 8.

Terry McAuliffe and his out of state cash....

RICHMOND -- While his Democratic rivals confined their travels to Virginia, gubernatorial candidate Terry McAuliffe quietly slipped out of the commonwealth a dozen times in recent weeks to attend fundraisers in his honor hosted by some of the nation's top Democratic donors. One day this month, he dashed from a morning roundtable in Roanoke, caught a United Airlines flight to Phoenix and landed in time for an evening event hosted by an Arizona Democratic activist. On another, he left on a pre-dawn U.S. Airways flight that required a plane change in Charlotte to get from a Chicago fundraiser to a midday event in Lebanon, Va., near the North Carolina border.

Near the N. Carolina Border? Good reporting there (LOL). Anyway, the writer brings up a good point -

Although McAuliffe's national contacts will help him raise millions, his energetic fundraising outside the state risks giving ammunition to rivals who say he is an outsider in Virginia, out of touch with state politics and residents' concerns. But McAuliffe says he sees no problems with the out-of-state money.

"The nice thing is people are helping me from all over," McAuliffe said. "I've had a lot of long relationships. These folks don't want anything from Virginia. They think I'd make a great governor."

I'm Terry McAuliffe and people from other states think I will be a great Governor of your Virginia" That's a winning slogan! The only chance the dems have to win is by outspending McDonnell.

Wind Power Blows

The BHC  - Is the Answer to Region’s Energy Needs Blowing in the Wind? tells one story. the NYT tells another - Cost Works Against Alternative and Renewable Energy Sources in Time of Recession.

Some experts not aligned with either camp estimate that wind power is currently more than 50 percent more expensive than power generated by a traditional coal plant. Built into the calculation is the need for utilities that rely heavily on wind power to build backup plants fired by natural gas to meet electricity demand when winds are calm.

And who will pay for this? YOU and ME.

Wise County Wind Farm...

Wise County Wind Farm....Yep. That's what we need.

APPALACHIA — Local interest was brisk as British Petroleum (BP) Wind Energy and Dominion, partners in wind energy projects, aired their interest in possibly developing a “wind farm” in Wise County during a public information meeting held in Appalachia on Tuesday.

The two energy companies began assessing Wise County’s potential as a wind energy locale in January on roughly 25,000-acre sites north of Big Stone Gap and Appalachia. The Penn Virginia properties known as Bluff Spur, Nine-Mile Spur and Rogers Ridge are ridgetop abutments to Black Mountain along the Kentucky border. - KT

They go on to tell how many jobs it would create and tax revenue the farm could provide. Sounds reasonable enough to me. Green energy in Wise County would be a good thing right? Enter the anti Dominion nutjobs..

Kimberly Hay, an environmental activist from Big Stone Gap, said she is suspicious of Dominion’s motives. Dominion is the utility building a 585 megawatt coal-fired power plant in St. Paul, a project opposed by environmental organizations. A consortium of environmental groups recently argued against the power plant before the Virginia Supreme Court.

“I’m thinking this is a lovely cover-up,” Hay said of Dominion’s interest in developing a wind farm. “They’re still clearing trees and eating up ridgelines. I think this is just an attempt to cover up for raping the mountains here. Use that word, ‘raping,’ because that’s exactly what it is. This wind farm thing, it’s just (public relations). There will be no trees here, no mountains or anything left when they’re done (mining the coal).”- KT

I talked to my Papaw on the phone today. He is in his eighties. He lived through the depression and is a WW2 hero. He now talks a lot about the old days and the war. He married his school days sweetie and she is still by his side...under his arm...in his heart. When I visit him we look at old B/W pictures and he speaks to my heart. I wonder if this generation is like his? This reminds me of him.

It has not been easy readjusting to life outside their one-man prison cells where they spent the last two years of their lives in segregation.

Since the commutation of their sentences by President Bush on his last day in office, the former agents, who were charged with the non-fatal shooting of a Mexican national after he abandoned a load of marijuana near the border, are learning to live in the world again.

Since being released from prison on Feb 17, both men were confined to house arrest for 31 days and were barred from speaking to the media until their sentences ended Friday.

United States Army Sergeant First Class Ed Malone

Malone

United States Army Sergeant First Class Ed Malone was serving with the 3rd Platoon, Grim Troop, 2nd Squadron, 3rd Armored Cavalry Regiment in 2005 and was conducting a joint combat patrol with the Iraqi Army in the extremely hostile Surai district of Tal'Afar, when the unit was attacked. Without immediate direct fire support from his Bradley Fighting Vehicles, Malone ordered his men to take a defensive position and return fire. He directed his grenadier to eliminate several enemy targets firing from a rooftop. Malone also repeatedly exposed himself to enemy fire -- once to retrieve important equipment, another time to evacuate women and children caught in the crossfire, and finally to drag a wounded soldier out of the line of fire. His actions sped medical treatment and evacuation, saving the soldier's life. Malone refused to give ground until reinforcements arrived, and he and his unit held their position for more than an hour. He led a three-man team to clear a courtyard of enemy fighters, relieving pressure on his unit. There, while administering aid to an enemy combatant, Malone was shot in the foot. For his brave actions that day, Malone was awarded the Bronze Star with combat "V" for valor.

Only a low life SOB would consider charging this man for his Valor.

As the BHC's rival newspaper The Kingsport Times sales increases, old Jtodd cry's a river - J. TODD FOSTER: When Newspapers Die, So Does An American Linchpin

The year will be 2039 and my 10-year-old grandson will climb onto the porch swing and sit next to me. He’ll be holding a yellowed newspaper – one of many that he found boxed in my attic.
“What’s this giant piece of paper, grandpa?” he’ll say.
A tear will form in the corner of one of my eyes and I’ll say softly: “It’s a newspaper.”

Jtodd continues to give reasons of why they failed. He blames those internets, bloggers, blah blah. Not once does he mention the shitty reporting, biased reporting, and the dim witted one sided editorial pages that he and others have used to turn away readers one by one. As I said to his fellow BHC writer Ms Tate - Look in the mirror sir. Tell your grandson the truth - We sucked son and the readers stopped buying it. Just like in the piece above that I proudly mention bringing down a corrupt president (Nixon) yet I forgot to tell you about the one that was impeached(Clinton). Yes son...Just like the unmentioned president and the lady he was involved with---We blew it.

The Fight Against Stonewall Jackson Continues...

A while back some bloggers made the cry to do away with Lee/Jackson day here in Virginia. In West Virginia the Charleston Gazette made this point:

West Virginia has Stonewall Jackson Lake, Stonewall Jackson Middle School, Stonewall Resort, Stonewall Jackson Lake State Park, a Stonewall Jackson statue on the Capitol lawn, and many others. Is it odd that so many tributes honor a general who fought against the United States in defense of slavery?

That is pretty much the same argument the Virginia bloggers stand on. "Defense of slavery" blah blah. My friend Jerry From on High sums it up:

Odd? Maybe.
But not to those West Virginians who paid for and erected those monuments that honor one of America's most famous - and successful - generals in its history, one who happened to be a native West Virginian.*
I wonder: Do the holier-than-thou dunderheads at the Gazette find it "odd" that the nation's most profoundly venerated cemetery - Arlington - also has a memorial dedicated to those who fought "in defense of slavery"?

Q6.  As someone seeking a statewide office, you will have a role in leadership.  McDonnell has called for Frederick to resign.  Where do you stand?

Brownlee: I look at this question from the perspective of a U.S. Attorney.  First thing you do is look at the evidence.  No one has shown me the evidence against Frederick.  I’ve seen the allegations, and they are very serious.  It would be inappropriate for me, particularly as a former U.S. Attorney, to sit here this evening to make a judgement about someone and make a judgement about someone else.  Cuccinelli has seen the evidence, so I will let him.  As a prosecutor, I have a great respect for jury verdicts, and a great respect for elections.  The SSC will review this evidence.  It should be open and transparent, and the leaders of the party will make that judgement based on the evidence, and evidence alone.  That’s my advice as a former prosecutor.

Jeff Frederick is only the Beginning

The Jeff Frederick story continues over at Too Con. LI hits a new angle with his post - Three of a Perfect Pair (Not!)

Fellow Too Con author VA Blogger takes issue with LI's post and counters with - Unfair Associations.

I have made it clear that I believe Frederick should step down. That is the issue at hand, but in healing the party that is only the beginning. There is plenty of blame to go around. So if the SCC wants Frederick removed so be it. The we address the SCC's lack of guts to remove the powers so many chairpersons abuse. We must demand it. We must fight tooth and nail for it.

I supported Frederick but I cant condone his actions. I do not believe he can be an effective leader after this. But this battle to make our party better has only begun. I fully expect those calling for Frederick's head to also call for some cleaning up of the SCC. Are the grassroots up for the fight? I am.

Obama's Poll Numbers Lower than Bush

Obama's Poll Numbers Are Falling to Earth

Polling data show that Mr. Obama's approval rating is dropping and is below where George W. Bush was in an analogous period in 2001. Rasmussen Reports data shows that Mr. Obama's net presidential approval rating -- which is calculated by subtracting the number who strongly disapprove from the number who strongly approve -- is just six, his lowest rating to date.

Overall, Rasmussen Reports shows a 56%-43% approval, with a third strongly disapproving of the president's performance. This is a substantial degree of polarization so early in the administration. Mr. Obama has lost virtually all of his Republican support and a good part of his Independent support, and the trend is decidedly negative.

A detailed examination of presidential popularity after 50 days on the job similarly demonstrates a substantial drop in presidential approval relative to other elected presidents in the 20th and 21st centuries. The reason for this decline most likely has to do with doubts about the administration's policies and their impact on peoples' lives.....Read it all

Bob McDonnell's "March Madness" Removed - Tucker Martin's Air Ball?

Leave it to the Bristol Herald Courier! It seems the basketball pick um game was in violation of trademark rules.

It was a fun idea and nifty example of alliteration, a political slam dunk, but campaign organizers for Virginia gubernatorial candidate Bob McDonnell dropped the ball on a contest idea that infringed on a trademarked name.

McDonnell, a Republican, this week on his Web site unveiled a contest called “McDonnell March Madness” patterned after the NCAA basketball tournament.

Problem is that the words “March Madness” are under trademark protection by the NCAA. On Wednesday, Gail Dent, NCAA associate director of public and media relations, said in response to a Bristol Herald Courier inquiry that the organization can allow other groups to use the term through a licensing agreement – i.e. in exchange for big bucks. McDonnell’s campaign, however, did not ask.

Furthermore, because the NCAA is a nonprofit organization for tax purposes, it could not grant permission to a politician to use the words in a political campaign.

On Thursday, McDonnell’s director of communications, Tucker Martin, took the heat for the misnamed promotion. He said he’d been so focused on making sure the campaign wasn’t violating any other rules or laws – that it really isn’t gambling, that no money is changing hands, that people understand it’s just for fun – that the name thing got past him.

The contest has been renamed to McDonnell’s Bracket Madness. March Mayhem would have been my choice... But anyway, this is just another example of J. Todd Foster's hard hitting reporting. I gotta go. there is a March Madness sale on at the kitchen supply store. I'm gonna pick up a couple Super Bowls and a Stanley Cup.

Everyone Calls for Jeff Frederick to Resign and He Responds by Locking the Doors on Executive Committee Meeting!

Today Eric Cantor called for Jeff Frederick to step down. We can now add Frank Wolf, Robert Goodlatte, Randy Forbes, Robert Wittman to the list also. They join the Virginia Senate Republican Caucus and our next Governor, Bob McDonnell in those wanting Frederick to abandon ship.

Now Maximus is reporting Jeff Frederick has locked the doors on RPV's Executive Committee...bars them from meeting tonight at RPV HDQ....What's next? Jeff and Tim Boyer chaining themselves to the RPV HQ doors?

I am amazed at Frederick's actions. After Thursday's revelations and being caught in a outright lie I had hoped he would step down and ride off into the night. It is clear that is not going to happen. I think we are witnessing what was once a promising career being flushed down the crapper. The sad part is Jeff is pulling the chain himself. It is now obvious that we made a mistake supporting Jeff last year. Ohhh the damage done.

Jeff Frederick Gets Caught Lying? - You Wanted the Dirt and Now You Got It - GREED

The AP broke the 10 charges against Jeff. Needless to say everything many of us were hearing appears to be true. I told you it was ugly and a MESS.  Most troubling to me is this charge

1. Failure to transmit, in a timely manner, online contributions made to the Republican Party of Virginia and processed by his own company. Withholding 7% of online contributions made to the RPV for a period of weeks during the summer of 2008 after repeatedly assuring the Executive Committee that he was not using his company as a vendor for RPV.

Jeff Frederick said that was untrue - “false and without merit.”........Well JR at Bearing Drift offers up some very damning evidence.

"Of note is this FEC form obtained by Bearing Drift is a payment from RPV of $1384 in October 2008 to “ChargedContribution.com”. This site is managed by Gen-X Strategies - Frederick’s firm."

Is this not the same shady bullshit that plagued our past leaders? The same BS that led many of us to support Frederick last year only to get slapped in the face with it again.

Is the above act illegal? I am not a lawyer but I have stayed at a Holiday Inn Express long enough to know it is some shady unethical BS. If Frederick is dumb enough to do this and not understand the ethical problems it presents then he dang sure needs to be removed. I don't see how anyone can now argue that he remain chairman...Or that he can be an effective leader. What a embarrassment to our party. I supported him on the blog last year, but never again. Until we purge the party of this type of behavior we will never  unite and win. What a shame it had to come to this. The SCC gave Jeff ample time to resign. He chose this spotlight to shine on himself and unfortunately the party. It is no wonder McDonnell and the GOP Caucus wanted to distant themselves from Jeff.

Illegal or legal I dont know. Greedy, dishonest, and plain stupid is there for all to see. Frederick must be removed.

I am troubled with how this is all happening. I have not taken a side on this but if what I am hearing about Frederick is correct he should step down. I fully respect the fact that Jeff was elected by the grassroots. I tell you though...If what I am hearing is correct I don't see how I or anyone can support him in this battle.

Some are calling for the reasons to be made public. Is that what we really want to happen? IMHO the RPV SCC and those supporting removing Frederick have the dirt on him. I don't think these folks are supporting this action without good reason and verifiable evidence. If they are then they will pay big time for this. WHAT A MESS.

What ever the outcome - My question is after all this can Frederick ever be a effective leader? I have my doubts.

• Distributing Oxycontin, a Schedule II controlled substance, which is an unclassified felony punishable by up to 40 years in prison and/or a fine of up to $500,000;
• Conspiracy to distribute Oxycontin, a felony punishable by up to 40 years in prison and/or a fine of up to $500,000;
• Distributing a controlled substance within 1,000 feet of school property, an unclassified felony punishable by one to five years in prison and a fine of up to $100,000; and
• Conspiracy to distribute Oxycontin within 1,000 feet of a school, a felony punishable by up to 40 years in prison and/or a fine of up to $500,000.

125 years in prison sounds about right to me...or a tall tree and a short rope. I think most of us that work for a living get drug tested. Why are our teachers and school officials not intensively drug tested? I mean if you drive a school bus you get tested...In my opinion if you work for the school system or have anything to do with children you should be tested. What if a kid had found his stash? This was a tragedy ready to happen.

Wise County Real Estate Reassessment - Tax Me!

SWAC Girl and Yankee Phillip have kept me up to date on the fight over the tax rate in SWAC land. I'm Not Emeril has a good post up that offers a lot of info on where to lay the blame. Here in sweet home Wise County the BOS will open up the mic tonight.

When county supervisors meet this Thursday, they will open up the podium and microphone to anyone with an opinion on the county’s tax rate.
Due to this year’s real estate reassessment, if supervisors maintain the current tax rate of 57 cents per $100 of assessed value, the county will realize more than a 1 percent increase in real estate tax revenue. To keep real estate tax revenue the same as last year, the board of supervisors would have to vote to cut the tax rate back to 50 cents.
After this Thursday’s public hearing, supervisors are expected to pick a tax rate and vote on it by the end of the month. They are expected to officially vote on the tax rate March 31, at a meeting specifically set for that purpose. - From The Coalfield Progress. (It's Our Great Paper and you cant read it free!)

The board has a GOP majority so I look forward to the outcome. To be honest, I think our tax rate is reasonable compared to other locations.

Salem's Mass Meeting - Another John Brownlee Win?

Greg reports record numbers of people turning out to be delegates!

"Once again we packed the Salem Courthouse (time to look for a new location). More exciting than that though was the number of Delegates who signed up. Last year Salem took 6 delegates to the Convention. This year we have 85+ signed up."

AWESOME! Same thing for my tiny unit in Wise County. We will be sending twice the number of delegates as last time and we are united to support John Brownlee. Salem is not completely united, but Greg reports -

"As for who "won" the Delegate count, I can't give a precise answer. What I do know is that the Brownlee people personally delivered about 20 Delegates, Cuccinelli personally delivered about 10 Delegates (handwritten on a crumpled up piece of paper) and Foster didn't deliver any Delegates. Adding in the other "committed" folks I'm aware of I'd say Brownlee has +/- 50% of the Salem Delegates and Cuccinelli probably has +/- 15% of the Delegates. The remaining 35% are either undecided or have not indicated their preference."

I would say advantage Brownlee for sure! I hope they can unite behind Brownlee like Wise County has.

Jerry Lester Talks about John Brownlee

A few years ago, Buchanan County was hit by a horrible flood, one of the worst natural disasters I have ever seen in this region. My 99 year old grandmother was carried out of her flooded home in a bed sheet. A few minutes later, the home was washed away, she barely made it out alive.

However, she died a few months later and did not live to be 100 years old. The flood simply took away her desire to live.

Local contractors were hired to clean up the community, but somewhere along the way they started conspiring with elected officials as well as business owners how they could fix the bids and pocket thousands of dollars for themselves. They thought they had gotten away with their scheme.

But the citizens of Buchanan County had a hero in a United States Attorney named John Brownlee. These people were convicted and sent to prison and over $1million was returned to our community due to the hard work of Mr.Brownlee. This is one of many reasons I support John in his campaign.

He is a person who has made a lifetime commitment to public service, whether it be as a soldier, a prosecutor or as a God-fearing man, John Brownlee will not need on the job training as Virginia's "Top Cop".

I have witnessed, first-hand, the work he has done as United States Attorney and I know John is a man of honor and integrity and will be a great Attorney General!

This is Brownlee Country!

Spend Spend Spend and Obama Breaks his Promise..Again

WASHINGTON (AP) - Members of both parties Monday voted to keep their cherished home-state projects as the Senate resumed debate on a spending bill covering foreign aid and domestic agency budgets.

By a 63-32 vote, lawmakers rejected a bid by Sen. John McCain, R-Ariz., to effectively strip about 8,000 of those earmarks from the $410 billion measure.

"If the president really wants to change Washington, as soon as this bill reaches his desk, he should veto it and send it back and say, 'Clean it up,'" McCain said.

Instead, the White House says President Barack Obama will sign the measure, despite all the projects. During last year's campaign, Obama he promised to cut the number of earmarks way back and institute other changes.

But lawmakers in both parties defend the practice, and 10 Republican joined most Democrats to defeat McCain's amendment.

The Big O really fooled folks with the Hope and Change bullshit...Lets look at this again - "Instead, the White House says President Barack Obama will sign the measure, despite all the projects. During last year's campaign, Obama he promised to cut the number of earmarks way back and institute other changes."

And 10 Repubs joined the Pork Team. Spending up 8%. Trillion $ stimulating...When will it end?

BREAKING NEWS: Eastman To Cut $100 Million In Spending, Up To 300 Jobs

KINGSPORT, TN - Just 2 months after slashing spending by $100 million, Eastman Chemical Company announced another round of spending cuts Monday morning in an effort to increase cash flow. As part of the cost cuts, the company plans to cut between 200 and 300 within the next 4 to 6 weeks. Employees will see a base pay reduction of 5%.

Round two of the cuts will slash spending by the Kingsport-based chemical company by another $100 million, bringing Eastman’s expected total cost savings this year to more than $200 million, according to a news release issued early Monday.

Democrats in control since 2007 and the Big O's stimulating stimulus we have this on 3/9/2009:

The Dow Jones industrial average fell 79.89, or 1.2 percent, to 6,547.05.

The Standard & Poor's 500 index fell 6.85, or 1.0 percent, to 676.53.

The Nasdaq composite index fell 25.21, or 2.0 percent, to 1,268.64.

For the year:

The Dow is down 2,229.34, or 25.4 percent.

The S&P is down 226.72, or 25.1 percent.

The Nasdaq is down 308.39, or 19.6 percent.

John Brownlee - Delegates

In our last Report, we mentioned that we had just received news of winning 100% of the delegates in King & Queen County.  Shortly after that report was sent, we were told we had secured 100% of the delegation in Wise County.

Tonight, John was the only candidate present at the City of Staunton mass meeting.  Staunton elected 27 delegates to this year's convention, and John reports a majority of those delegates indicated support for his campaign.

In Dickenson County, 20 delegates were elected tonight; All but one of them support John Brownlee.

Good news for John! 100% of Wise County Delegates are united for John Brownlee.
