Commonwealth attorney fighting to keep job while he serves in Iraq
"RICHMOND, Va. (AP) -- A Floyd County prosecutor wants to keep his job while he serves in Iraq, and he's asked the state Supreme Court for help.
Gordon Hannett, Floyd commonwealth attorney, is going to Iraq as captain of a Salem-based brigade of the Army Reserve's 89th Division. Hannett filed a petition with the state Supreme Court on Tuesday asking justices to force Circuit Judge Ray Grubbs to give him back his $5,300-a.m.onth job.
Hannett claims Grubbs didn't have jurisdiction to replace him last week. He had proposed running the office through e-mail and phone conversations while an assistant prosecuted cases in his absence. But Grubbs swore in a full-time prosecutor on Thursday to replace Hannett while he is in Iraq.
Later that day, Hannett swore in a different attorney, making it a situation only the state's highest court can resolve."
